The said privacy policy is of ARN Lifestyle Private Limited (hereinafter referred to as "ARN") and it shall govern, manage the information and documents received towards use of ARN's website (www.indiadesignhouse.com) for purchase of Product offered therein for sale, membership for loyalty programs, other offers, shipping, refund and return, cancellation, query resolution, support, and other service, facilities made available for the Users.

1. Definition

1. ARN Lifestyle Private Limited shall throughout the Data & Privacy Policy be referred to as "ARN".
2. The words "You", "User", "Purchaser", "Consumer", used herein and interchangeably referred throughout the Terms and Conditions and Data & Privacy Policy herein shall mean a Person logging into, browsing, or purchasing from the Website of ARN.
3. That www.indiadesignhouse.com shall throughout the Data & Privacy Policy be referred to as "Website", owned and managed by ARN. The Website is hosted on Shopify's platform, which is run and operated by Shopify Commerce Singapore Pte Ltd.
4. That "India Design House" is the trade name of ARN for carrying out its business, including but not limited to, selling of furniture, home décor, home furnishing etc. That India Design House shall throughout the Terms and Conditions and Data & Privacy Policy herein be referred to as "IDH".
5. The items sold by ARN under the branding of IDH or otherwise through the Website shall be termed throughout the Terms and Conditions as "Product".
6. The word "Person" shall mean both natural and juristic entities.
7. Information – Name, Phone number, email address, address (physical address), order details, payment status, payment details like, account number, GST details, credit card number, debit card number, UPI details, purchase history, IP address, browser type, device information, cookies, customer queries, feedback and reviews, WhatsApp messages, chat records, comments on Website, login details, website usage information and any other information voluntarily provided in the Website.

2. Use of Information & Documents

1. The information asked from a User is for the purpose of (i) taking, confirming an order (ii) delivering the confirmed order (iii) coordinating delivery of Products at User's address (iv) for order fulfillment wherein order confirmation is communicated via email, SMS or WhatsApp (v) for customer support wherein query, request, complaints against services or Product is escalated to ARN and its response, remedy is reverted on User's email, SMSed or messaged over phone (vi) for processing payment (vii) for receiving communications and offer announcements from ARN, (viii) for receiving marketing communications and (ix) for any legal and statutory purposes.
2. The documents and information received pursuant to the purpose shall not be disseminated to any third party without the express consent of the User, Consumer, except as provided in clause (c) below.
3. For the purpose mentioned herein ARN would share the information with (1) manufacturing partners (2) shipping / logistic partners (3) payment gateways and service providers (4) legal authorities if required under law or mandated as per any court / tribunal order (5) to recipients as permitted therein the Shopify Consumer Privacy Policy and (6) to third-party service providers engaged by ARN for purposes specified in 3(a),(d) and for ancillary services.
4. That as ARN's Website is hosted on Shopify's platform, as per Shopify's Terms of Service, Shopify will store and use the Information shared to ARN as per Shopify's Consumer Privacy Policy. The policy can be viewed here: Shopify Privacy Policy - Shopify India
5. That ARN may opt for some additional services from Shopify. In such case the Information shared with ARN will be processed by Shopify as per its additional terms (Shopify Data Processing Addendum), wherein Information could be shared with third parties that may be located in other countries. 3. Cookies

1. The website shall contain certain cookies which will be used for enhancing the user interface of said website, and for making a User's, Consumer's usage experience of said website seamless.
2. The cookies on the "Payment Page" are not deployed by ARN. Such cookies are controlled by Payment Gateway service provider and may be used by Payment Gateway service providers as per their privacy policy and as per law.

4. The Website shall also have other cookies from other third-party service provider for advertising, marketing and helping ARN in business analytics. The terms of such third party service provider can be viewed here:

5. A User may disable the cookies by making necessary changes in the browser settings of the browser engaged by such User for accessing ARN's Website. However, disabling the cookies may impact the user interface of the Website and the information shared therein the Website with the help of these disabled cookies.

4. Limitation of Liability

1. That the ARN does not warrant that its website would be free from marketing publication. The links appearing, if any, if accessed, would lead a User, Consumer to a third-party website, and any dissemination of information, document by User, Consumer upon such link shall be solely at their risk and that ARN shall not be held liable for any loss or misappropriation of such furnished documents, information.
2. The ARN shall only be liable if the information received through the cookies is unlawfully, fraudulently, negligently, unauthorizedly disseminated to any third party.
3. That the User, Consumer should be aware that accessing unknown, unverified links may breach such User, Consumer's computer system's safety wall and corrupt the information stored, save therewith, and may also lead to data theft. Thus, it is advisable to not click upon any unknown, unverified link. Any loss of data and/or theft of the same or embezzlement from account would not be attributed to ARN in any case.

5. Warranty

1. The ARN states that its website would be managed by third party vendors and is hosted on Shopify's platform. ARN hereby warrants that whatever data safety process is provided by Shopify, it shall 'as is' share it with the User. Further, it shall also share with the User the data safety processes of Meta and Google Analytics.
2. The ARN warrants that it shall reasonably assist a User with respect to any grievance, issue or concern in relation to Shopify, Meta and Google Analytics.
3. That ARN herein states that its Website shall be reasonably secured to safeguard information and documents, reposited vide Cookies, received through its Website. However, the ARN exclusively disclaims, any liability hereunder this Privacy Policy, if its Website, is disrupted, invaded by foreign elements, hackers, corrupting, extracting data, information, then ARN shall not be liable for any loss suffered due to invasion by such foreign elements, hackers. Nevertheless, as soon, the ARN gets to know or is informed about such malpractice, it shall promptly shut down its Website temporarily and it will intimate about such an incident to all registered Users and Consumers.
4. ARN herein states that the personal information, documents, information received via cookies and Website shall be stored on a third-party server of Shopify, Meta and Google Analytics. The terms and conditions of such third-party repository space provider shall be in addition to this Privacy Policy and not in substitution. However, the ARN exclusively disclaims, any liability hereunder this Privacy Policy, if said third-party server is disrupted, invaded by foreign elements, hackers, corrupting, extracting data, information, then ARN shall not be liable for any loss suffered due to invasion by such foreign elements, hackers. Nevertheless, as soon as the ARN gets to know or is informed about such eventuality, it shall urge such third-party repository space provider to promptly provide a list of documents, information which has been affected, and to take appropriate measures, action to mitigate such loss and impact.
5. ARN, if requested by a User, shall assist them reasonably in getting their information deleted, corrected or seeking any other action, as permitted by Shopify, Meta and Google Analytics vide its policy or from any other authorized recipient. However, payment gateway services providers may retain information to the extent permitted under law.

6. Support

1. That during the occasion of website, application outage, dysfunction as stated hereunder 5(c), the members can reach out on the help line number given by ARN or the system, process communicated for availing all the services during such period of shutdown of website, application.
2. That a User may manage deletion, correction and other action with respect to its Information by accessing the following link of Shopify: https://privacy.shopify.com/en
3. That a User may reach out to ARN at hello@indiadesignhouse.com for withdrawing its consent given towards receiving marketing communications.
4. That in case there is any query with respect to this Privacy Policy, a member can reach out at: hello@indiadesignhouse.com.
5. That any request submitted hereunder this Clause shall be initiated within 30 days after receipt of such request.

7. Payment

1. That the payments on the Website will be processed by third-party payment gateways who may collect payment-related information in accordance with their privacy policy.

8. Dispute Resolution

1. That this Privacy Policy shall be governed by the Law of Republic of India. That the Courts of New Delhi shall have the exclusive jurisdiction against any disputes arising out of this Privacy Policy. That any disputes arising out of Privacy Policy shall be subjected to arbitration proceedings as per Arbitration and Conciliation Act, 1996, as amended time to time. The arbitration shall be conducted by a sole arbitrator appointed by the Court having jurisdiction and authority of adjudication or if both the parties agree the arbitration could be referred to DIAC or any other institution arbitration as agreed by both. In case of ad-hoc arbitration the seat and venue of the arbitration would be New Delhi. The cost of arbitration, in any case, shall be borne by both the parties.

9. Intimation

1. That ARN will promptly, within 72 hours, intimate via email to a User, Consumer, Purchaser in case their information or documents are unauthorizedly disseminated or have been accessed through unlawful means, vide disruption invasion by foreign elements, hackers. The ARN assures that it will make all reasonable efforts by taking steps to mitigate any impact or loss suffered due to it and shall also assist such affected User in case they decide to pursue any legal remedy in safeguarding themselves.

10. Consent

1. That the User, Purchaser, Consumer herein after fully understanding the Privacy Policy in words and spirit and having all doubts cleared acknowledges giving his well-informed consent to be bound by this Privacy Policy. That the consent given herein can anytime be withdrawn through proper intimation and per policy terms.

11. Retention and Deletion

1. That ARN shall retain Information as permitted under law with respect to accounting and auditing, and upon efflux of the prescribed period shall destroy the said information.
2. That the Information shall also be retained as per the Policy Terms of Shopify and other third-party service providers herein.
3. That a User may initiate deletion process as per clause 6 herein the Policy, and in case of any assistance required with regard to it they can reach out at: hello@indiadesignhouse.com.
4. That any request submitted hereunder this Clause shall be initiated within 30 days after receipt of such request.

12. Grievance Officer

Any complaints pertaining to the Privacy Policy can be made to the officer named herein. That ARN will within 10 working days after receiving the complaint shall reach out to necessary party, personnel or initiate necessary action on such complaint.

13. Complete Privacy Policy

1. That the policy herein should be read in conjunction with relevant policy terms enumerated herein of third-parties providing necessary services in enabling ARN tender its services vide its Website. However, the policy herein shall take precedence in case of any conflict with other relevant policy terms.

14. Changes to Privacy Policy

1. That ARN reserves the right to modify its Data & Privacy Policy without any prior notice. A User's access, use, browsing of ARN's Website shall be deemed as an implied acceptance to the Data & Privacy Policy along with its amended terms. A User is herein advised to review the Data & Privacy Policy from time-to-time to be informed of amendment(s), modification(s), if any.
